For individuals who have the good fortune of having multiple nationalities, there are additional options when applying for E1 and E2 Visas.
One option is the ability to apply for an E Visa in either nationality.
It is very important to give careful thought and consideration into which nationality to use in the E Visa application.
E2 Visa Dual Nationality – Two Main Factors to Consider
With dual citizenship, a foreign national can choose which nationality to use when applying for an E-2 visa (as long as both countries are E-2 treaty countries with the United States).
What are the most important factors to consider in an E Visa application?
1. E Visa applicants need to consider the E Visa period of validity provided by each country. See the USCIS reciprocity schedule.The reciprocity schedule refers to the length of time for which the E-2 visa is valid. The amount of time an E2 Visa is issued is based on the agreement of reciprocity between the applicant’s country and the United States. Generally, the country with the longest period of E Visa validity is preferred to use as the country of origin.
2. E Visa applicants need to consider the country in which their employees reside. If key employees reside in one country of the dual nationality – then the visa would optimally be applied for using the country in which the employees reside. E Visas First Step – Determining Eligibility
The visa applicant must be from a country that is one of the US Treaty Visa countries. There are less than 100 countries that have E2 Visa treaties with the US. Not all individuals in all countries will be eligible for an E2 visa.

• Plan to Succeed: The U.S. government wants to see that the foreign investor has planned for success. Accordingly, the investor should provide a detailed Five Year Business Plan – forecasting capacity to generate sufficient revenue to exceed minimal living standards.

• Create US Job Opportunities: The foreign investor / entrepreneur should provide evidence to show that the enterprise will create job opportunities in the U.S. By expanding jobs in the U.S. economy, the investor can increase his or her probabilities of obtaining the E2 visa.
• Provide Evidence for Income Generation: An E2 applicant is to provide evidence that the enterprise will generate significant income at a level that is above a standard living income for the total number of family members in the investor’s household.
• Provide Documentation for Source of E2 Visa Investment: If the enterprise has the capacity to generate significant income then the investor should provide evidence. For example, if the enterprise has already generated high sales volume, then the investor should provide bank statements and Profit & Loss statements to support the declaration of high income.
